Putting an end to the long running battle between Unison and the UK Government, the Supreme Court has found in favour of Unison and ruled that Employment Tribunal fees are unlawful. The judgment is a humiliating result for the Government which will now have to refund an estimated £32 million in fees paid since July 2013.
The Supreme Court advised that its decision was based on the fact that Tribunal fees were “inconsistent with access to justice” and discriminatory against women and minorities in contravention of the Equality Act 2010.
Justice Minister Dominic Raab responded to the judgment saying “we respect the judgment and we are going to take it fully on board and we are going to comply with it”.
