Have you been sacked because you are pregnant? Are you unsure of your maternity rights? Is your partner having a baby and you would like time off for the birth? Are you confused by the rules?
If you are pregnant, your employer must carry out appropriate health and safety assessments and allow reasonable time off to attend medical appointments. While you are on maternity leave, you may be eligible for maternity pay, statutory maternity pay or maternity allowance and your employer must keep your position open for you on your return. If they don’t you may have claims for unfair dismissal and also for sex discrimination. Fathers also have rights to take paternity leave, and parents have rights to request parental and adoption leave subject to certain conditions.
If your child was born or adopted after 5 April 2015, you and your partner may also be able to take shared parental leave. This is a complex topic and we can guide you through the many rules and requirements and help you make a request to your employer.
At Backhouse Solicitors, we are experts in employment law and all aspects of maternity, paternity and parenting leave. If you feel that your employer has not complied with the law, or that you have been discriminated against because you are pregnant then we can help. We will give you a free, no-obligation 30 minute appointment to discuss your case with you and to help you decide how to proceed. If you decide to issue a tribunal claim, we can provide expert assistance at every stage, including issuing your claim, preparing your case, negotiating with the other side and representing you at the employment tribunal. We understand that while you are pregnant or looking after a baby you may need a lot of support and we are here to help.
